This website, www.hydroflow.ca, is operated by Good Question Marketing Inc., operating as HydroFLOW Canada ("HydroFLOW Canada," "we," "us," or "our").

HydroFLOW Canada is a Canadian business based in Burlington, Ontario, providing electronic water-conditioning products, related information and customer support to customers throughout Canada.

These Terms of Service ("Terms") govern your use of our website, online store and related services.

By using our website or purchasing products through our online store, you agree to these Terms and any additional policies expressly referenced in connection with your purchase, subject to applicable Canadian consumer protection laws.

Please read these Terms carefully before using our website or placing an order.

Our online store is powered by Shopify, which provides the ecommerce technology used to operate our website and process orders.

1. Eligibility and Website Use

Our website and online store are intended primarily for adults who have reached the age of majority in their province or territory of residence.

You agree to use our website and services only for lawful purposes.

You must not:

  • Use our website for fraudulent or unlawful activities.

  • Attempt to interfere with website security or functionality.

  • Transmit viruses, malicious software or other harmful code.

  • Use automated systems to scrape or collect information without authorization.

  • Infringe upon our intellectual property rights or the rights of others.

  • Misrepresent your identity or provide intentionally false information.

We may restrict or suspend access to our website where reasonably necessary to protect our business, customers or website security, subject to applicable law.

2. Canadian Sales and Service Area

HydroFLOW Canada currently sells and supports its products within Canada.

Orders placed through our online store are intended for delivery to valid Canadian shipping addresses.

We reserve the right to decline orders for delivery outside Canada or where fulfillment is unavailable, subject to applicable consumer protection laws.

Products purchased from retailers or distributors outside Canada may be subject to the policies and support arrangements of those sellers.

3. Products and Product Information

HydroFLOW Canada offers electronic water-conditioning products designed for various residential, commercial and industrial applications.

We make reasonable efforts to provide accurate product descriptions, specifications, installation information and pricing.

Product images are intended to represent the products offered, although packaging, appearance or accessories may vary where properly disclosed.

We may update product specifications, product availability or product descriptions as necessary.

Any material changes affecting an accepted order will be handled in accordance with applicable consumer protection laws.

Customers are encouraged to contact us before purchasing if they have questions about product selection, sizing, installation or suitability for a particular application.

4. Product Performance and Application

HydroFLOW water-conditioning systems use electronic water-conditioning technology intended to help manage certain water-related conditions, including limescale formation and accumulation.

Product performance may vary depending on factors such as:

  • Water chemistry and hardness.

  • Plumbing materials and configuration.

  • Equipment sizing and installation location.

  • Water temperature and flow conditions.

  • Existing scale deposits and system condition.

  • Operating and maintenance practices.

Product descriptions, technical studies, customer testimonials and case studies are provided to explain product applications and observed results.

Individual results may vary, and a particular customer's results are not guaranteed unless expressly stated in an applicable written warranty or guarantee.

HydroFLOW systems are not represented as substitutes for equipment or treatment required to address water safety, microbiological contamination or other conditions outside their specified applications.

Customers should review the applicable product information and contact HydroFLOW Canada if they are uncertain about suitability for their intended application.

Nothing in this section reduces any express product representation, applicable warranty, guarantee or statutory consumer right.

5. Installation and Product Use

HydroFLOW products must be installed and operated in accordance with the manufacturer's instructions and applicable safety requirements.

Customers are responsible for ensuring that:

  • The correct product model is selected for the intended application.

  • Installation instructions are followed.

  • Electrical connections meet applicable safety requirements.

  • Products are installed in suitable environmental conditions.

  • Products are not modified or repaired without appropriate authorization.

Where professional installation is appropriate or required by applicable codes, customers should use a qualified service provider.

Improper installation, unauthorized modifications or operation outside specified conditions may affect product performance and applicable warranty coverage, subject to the terms of the relevant warranty and applicable law.

HydroFLOW Canada is available to provide product-selection and installation guidance.

6. Pricing, Currency and Taxes

Unless otherwise stated, all prices displayed on our website are in Canadian dollars (CAD).

Applicable sales taxes, including GST, HST, PST or QST, are calculated according to the customer's location and applicable tax requirements.

Shipping charges and any additional applicable fees will be disclosed before the order is submitted.

We reserve the right to change advertised prices and promotional offers prospectively.

Price changes do not apply retroactively to accepted orders unless permitted by law and agreed to where required.

We make reasonable efforts to maintain accurate pricing and product information.

If a material pricing or product-information error is identified before an order is accepted, we may contact the customer to confirm whether they wish to proceed at the corrected price.

If an accepted order cannot be fulfilled as agreed, we will contact the customer and provide an appropriate resolution, including a refund where required.

7. Orders and Payment

By placing an order, you agree to provide accurate and complete information necessary to process your purchase.

Orders are subject to payment authorization, product availability and applicable verification procedures.

An automated order acknowledgement confirms receipt of your order but does not necessarily constitute final acceptance of the order, subject to applicable law.

We may refuse or cancel orders where reasonably justified, including circumstances involving:

  • Suspected fraud or unauthorized payment activity.

  • Incorrect or incomplete delivery information.

  • Product unavailability.

  • Material pricing or listing errors identified before acceptance.

  • Orders that violate applicable laws or our disclosed sales restrictions.

Where an order is cancelled after payment has been collected, any required refund will be processed in accordance with applicable law.

We may limit quantities where reasonably necessary to address inventory availability or suspected unauthorized resale activity.

Customers will be notified of material order issues using the contact information provided during checkout.

8. Shipping and Delivery

HydroFLOW Canada ships products to eligible Canadian addresses using established shipping and courier services.

Available shipping options, charges and estimated delivery times are communicated during checkout or in applicable shipping information.

Delivery estimates are provided in good faith but may be affected by circumstances outside our reasonable control, including courier disruptions, weather events or other transportation delays.

We will comply with applicable consumer protection laws concerning delivery obligations, delays, cancellations and refunds.

Customers are responsible for providing accurate shipping information and should contact us promptly if an error is discovered.

If an order arrives damaged, incomplete or incorrect, please contact info@hydroflow.ca as soon as possible so we can assist.

9. Returns and Refunds

HydroFLOW Canada offers a separate 30-Day Returns & Refunds Policy for eligible residential purchases made directly from our online store.

Our standard voluntary return policy applies to unused and uninstalled products, subject to its published requirements.

All voluntary returns require prior written authorization from HydroFLOW Canada before products are shipped back.

Unauthorized returns are not accepted or refunded under our voluntary return program.

Customers are responsible for approved voluntary return shipping costs, including appropriate packaging, tracking and insurance, as specified in our Returns & Refunds Policy.

Returned products are subject to inspection. Missing components, physical damage, signs of installation or use, or reduced resale value may result in rejection of a voluntary return or reasonable refund deductions.

These conditions do not restrict any statutory cancellation, return or refund rights under applicable Canadian consumer protection laws.

Please review our complete Returns & Refunds Policy for details before requesting a return.

10. 12-Month Satisfaction Guarantee

Eligible HydroFLOW residential water-conditioning systems are supported by our separate 12-Month Satisfaction Guarantee.

This guarantee is distinct from our standard 30-day return policy and any applicable manufacturer's warranty.

The guarantee is governed by its own published eligibility requirements, procedures, limitations and conditions.

Nothing in these Terms creates an additional product trial, refund entitlement or performance guarantee beyond the applicable written guarantee or rights provided by law.

For further information, please review our 12-Month Satisfaction Guarantee or contact info@hydroflow.ca.

11. Manufacturer's Warranties

HydroFLOW products may be covered by applicable manufacturer's warranties against manufacturing defects.

The specific warranty terms and coverage periods depend on the product model and applicable warranty documentation.

Manufacturer's warranties may provide remedies such as repair or replacement, subject to their terms and applicable law.

Warranty eligibility may depend on proper installation, operating conditions and other requirements identified in the applicable warranty.

Manufacturer's warranties and HydroFLOW Canada's voluntary guarantees operate in addition to any legal warranties or remedies available under applicable Canadian consumer protection laws.

No provision of these Terms excludes or limits statutory legal warranties that cannot lawfully be waived.

12. Customer Accounts and Personal Information

Customers may be able to create an account or provide information to facilitate purchases and customer support.

You agree to provide accurate information and take reasonable steps to protect any account credentials.

Personal information collected through our website is handled in accordance with our Privacy Policy and applicable Canadian privacy legislation.

Our Privacy Policy describes how we collect, use, disclose, retain and safeguard personal information, including information shared with Shopify and authorized service providers.

Please review our Privacy Policy for further information.

13. Marketing Communications

HydroFLOW Canada may offer customers the opportunity to receive promotional emails, product information, special offers and educational communications.

Marketing communications are managed in accordance with Canada's Anti-Spam Legislation and other applicable laws.

Where consent is required, customers may choose whether to subscribe to marketing communications.

Customers may unsubscribe from promotional communications using the unsubscribe instructions provided or by contacting info@hydroflow.ca.

Necessary purchase-related, delivery and customer service communications may continue where permitted by law.

14. Intellectual Property

The content on our website, including text, graphics, photographs, product descriptions, technical materials, trademarks, logos and website design, is owned by HydroFLOW Canada, its licensors or other applicable rights holders.

Website content may not be copied, reproduced, distributed, modified or commercially exploited without appropriate authorization, except as permitted by law.

HydroFLOW and related product names, trademarks and logos remain the property of their respective owners.

Customers may access and use website content for lawful personal and purchasing-related purposes.

15. Customer Reviews, Testimonials and Submissions

Customers may voluntarily provide product reviews, testimonials, comments, photographs or other feedback.

By submitting content for publication, you confirm that you have the necessary rights to share that material.

Where we request permission to publish identifiable customer testimonials, photographs or other personal information, we will obtain appropriate consent as required by law.

We may moderate or remove submissions that are fraudulent, unlawful, abusive, misleading or infringe the rights of others.

We will not knowingly present customer reviews, testimonials or performance results in a materially misleading manner.

Published reviews and case studies may represent individual customer experiences and do not necessarily establish the results that every purchaser will experience.

16. Third-Party Websites and Services

Our website may include links to third-party websites or services, including payment providers, delivery services, social media platforms and product information resources.

These third parties may have their own terms, privacy policies and operating practices.

HydroFLOW Canada does not control independently operated third-party websites and is not responsible for their content or practices, except to the extent responsibility is imposed by applicable law.

Customers should review relevant third-party terms when using external services.

17. Website Availability and Security

We make reasonable efforts to maintain an accurate, secure and accessible website.

However, website access may occasionally be interrupted by maintenance, system upgrades, technical problems or circumstances beyond our control.

We do not guarantee uninterrupted or error-free website availability.

We may suspend or restrict website functionality when reasonably necessary for maintenance, security or operational purposes.

Nothing in this section limits obligations or remedies that cannot be excluded under applicable law.

18. Limitation of Liability

To the extent permitted by applicable law, HydroFLOW Canada is not responsible for losses arising solely from:

  • Unauthorized or improper use of our website.

  • Customer modifications to products contrary to manufacturer instructions.

  • Improper product installation or operation outside specified conditions, where the loss is attributable to that conduct.

  • Website interruptions or technical failures outside our reasonable control.

  • Acts or omissions of independent third parties for which we are not legally responsible.

To the extent permitted by applicable law, we exclude liability for indirect, incidental or consequential commercial losses that are not reasonably attributable to a breach of our legal obligations.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including applicable consumer protection rights, statutory warranties, remedies for defective products or liability for personal injury where such exclusions are prohibited.

Any limitation of liability is subject to applicable federal and provincial law.

19. Indemnification

To the extent permitted by applicable law, users may be responsible for reasonably foreseeable losses or third-party claims directly resulting from their unlawful use of our website, infringement of third-party rights or intentional misuse of our services.

This provision does not impose responsibility on consumers for losses caused by HydroFLOW Canada's own acts or omissions and does not restrict statutory consumer rights.

20. Commercial and Industrial Purchases

Commercial and industrial equipment purchases made through quotations, purchase orders or separate agreements are governed by the applicable commercial documentation, including HydroFLOW Canada's Commercial Terms & Conditions and relevant manufacturer's warranty.

The standard residential 30-day return policy and 12-Month Satisfaction Guarantee do not apply to commercial and industrial purchases unless expressly agreed in writing.

Where a separate written commercial agreement applies, that agreement governs the relevant transaction to the extent permitted by law.

21. Corrections, Changes and Updates

We may update website information, product descriptions, pricing and these Terms from time to time.

Changes to these Terms will be published on our website with an updated revision date.

Unless otherwise permitted by applicable law and agreed to where required, changes will not retroactively alter the terms of a previously accepted purchase.

If a material change affects an existing customer agreement, we will provide any notice or obtain any consent required by applicable law.

22. Governing Law and Consumer Rights

These Terms are governed by the applicable laws of Ontario and Canada, subject to mandatory consumer protection laws that may apply in the customer's province or territory of residence.

Nothing in these Terms requires consumers to waive protections, remedies or legal rights that cannot be waived under applicable provincial or federal law.

Where a provision conflicts with mandatory consumer protection legislation, the applicable statutory requirement will take precedence.

Any legal dispute will be addressed in accordance with applicable law, including any mandatory rules concerning jurisdiction and consumer remedies.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be limited or severed to the extent necessary, where legally permitted.

The remaining provisions will continue to apply to the extent permitted by law.

24. Entire Agreement

These Terms, together with applicable policies and conditions disclosed and incorporated as part of a purchase, form the agreement governing use of our website and relevant online-store transactions.

They do not override separate written agreements, express product representations or statutory rights that apply to a particular purchase.

Where separate commercial agreements apply, those agreements govern the relevant commercial transaction as specified in Section 20.
